Welcome to Chittoo.
These Terms and Conditions ("Terms") govern your access to and use of the Chittoo website, mobile applications, products and services provided by Chittoo Technologies India Private Limited ("Chittoo", "we", "us", or "our").
By accessing our website, downloading or using the Chittoo application, creating an account, purchasing a subscription, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not access or use Chittoo.
Please read these Terms together with our Privacy Policy and any other terms or policies specifically applicable to a particular Chittoo product or service.
1. About Chittoo
Chittoo is an English-language learning and communication practice platform that provides users with tools and content to practise English vocabulary, grammar, pronunciation, speaking, listening and conversation skills.
Our services may include, depending on your plan, location, device and product version:
English vocabulary and phrase practice
Grammar and sentence practice
Speaking and conversation practice
AI-powered conversations
Pronunciation and accent-related feedback
Voice recording and re-recording features
Learning activities, exercises and quizzes
Progress and practice insights
Personalised learning content
Other learning features that we may introduce or modify from time to time
Features may vary across platforms, subscription plans, countries and versions of the application.
2. Eligibility
You may use Chittoo only if you are legally permitted to enter into a binding agreement under applicable law.
If you are under the applicable age of majority in your jurisdiction, you may use Chittoo only with the involvement and consent of a parent or legal guardian where required by law.
Parents or guardians are responsible for ensuring that any use of Chittoo by a minor is consistent with applicable law and these Terms.
3. Creating an Account
Certain Chittoo features may require you to create an account.
When creating an account, you agree to:
provide information that is accurate and current;
maintain the confidentiality of your account credentials;
not share your account with another person unless expressly permitted by Chittoo;
promptly notify us if you believe your account has been accessed without your permission; and
remain responsible for activity conducted through your account, subject to applicable law.
You must not create an account using another person's identity or information, or attempt to gain unauthorised access to another user's account.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
4. Use of the Chittoo Service
Chittoo grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Chittoo service for its intended educational purposes.
You must not:
use Chittoo for any unlawful purpose;
copy, reproduce, modify or redistribute Chittoo's content without permission;
reverse engineer, decompile or attempt to extract the source code of the application, except where such restriction is prohibited by applicable law;
interfere with the operation or security of the service;
attempt to gain unauthorised access to Chittoo's systems or another user's account;
use automated systems, bots or scraping tools to access or collect Chittoo content unless expressly authorised;
circumvent usage limits, subscription restrictions or other technical controls;
sell, rent, sublicense or commercially exploit access to your Chittoo account;
upload malicious software, viruses or other harmful code; or
use Chittoo in a way that could damage, disable, overburden or impair the service or interfere with another user's use of the service.
5. Learning and AI Features
Some Chittoo features may use artificial intelligence or automated technologies to provide conversation, language, pronunciation, grammar or other learning feedback.
AI-generated responses and feedback are intended to support learning and practice. They may occasionally be incomplete, inaccurate, inappropriate or incorrect.
You should therefore use your own judgement when relying on AI-generated information or feedback.
Chittoo does not represent that every AI-generated response will be accurate, error-free or suitable for every learning situation.
AI features may be changed, improved, limited or discontinued from time to time.
6. Voice Recordings and Practice Content
Some Chittoo features allow you to record your voice, participate in conversations, submit text or otherwise provide content for the purpose of using the service.
You retain your rights in content that you submit to Chittoo, subject to the rights and permissions necessary for us to provide the service.
By submitting content to Chittoo, you grant Chittoo a limited licence to host, process, reproduce, analyse and otherwise use that content to the extent reasonably necessary to:
provide the requested service;
generate learning or language feedback;
operate and maintain Chittoo;
improve the functionality and reliability of our services;
protect the security and integrity of the service; and
comply with applicable law.
Where personal data is involved, our processing of that data is governed by our Privacy Policy and applicable data-protection law.
Chittoo will not use your submitted content for unrelated purposes that are not permitted under applicable law or our Privacy Policy.
7. User Content
You may be able to submit text, recordings, responses, feedback or other content through Chittoo ("User Content").
You remain responsible for the User Content that you submit.
You represent that you have the necessary rights and permissions to submit the User Content and that your submission does not violate applicable law or the rights of another person.
You must not submit User Content that:
is unlawful, fraudulent or misleading;
infringes another person's intellectual property, privacy or other legal rights;
contains malicious software;
is abusive, threatening, defamatory or harassing;
contains content that you are not legally entitled to share; or
is otherwise prohibited by applicable law.
We may remove or restrict access to User Content where reasonably necessary to operate the service, enforce these Terms, protect users, or comply with applicable law.
8. Intellectual Property
All content and materials made available through Chittoo, including but not limited to:
the Chittoo name and brand;
logos and trademarks;
application software;
website design;
text and written content;
learning exercises;
questions and quizzes;
audio and visual materials;
graphics and illustrations;
learning frameworks;
user-interface elements;
AI systems and related technology; and
other Chittoo-created materials
are owned by or licensed to Chittoo and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, publish, transmit, sell, license, create derivative works from, or commercially exploit Chittoo's intellectual property.
Nothing in these Terms grants you ownership of Chittoo's intellectual property.
9. Subscriptions and Paid Services
Certain Chittoo features may be available only through a paid subscription.
The applicable subscription price, billing period, trial period, features and other conditions will be displayed to you before you complete your purchase.
By purchasing a subscription, you authorise the applicable payment provider or app store to process the applicable charges.
Subscription pricing may vary by country, platform, taxes, promotional offers and subscription type.
Chittoo may change subscription prices in the future. Where required by applicable law, we will provide notice of material price changes before they take effect.
10. Free Trials and Promotional Offers
Chittoo may offer free trials, introductory offers or other promotions from time to time.
The terms applicable to a particular trial or promotion will be disclosed when you sign up.
Unless otherwise stated, a free trial does not guarantee continued free access to paid features after the trial period ends.
Where a trial converts automatically into a paid subscription, the applicable price and renewal terms will be presented to you before or at the time you begin the trial, subject to applicable law and the rules of the relevant app store or payment provider.
Chittoo may modify or discontinue promotional offers at any time, subject to applicable law.
11. Cancellation and Refunds
If you purchase Chittoo through the Apple App Store, Google Play or another third-party platform, subscription management, cancellation and refunds may be governed by that platform's applicable terms and policies.
If you purchase directly from Chittoo, cancellation and refund terms applicable to that purchase will be communicated at the time of purchase or through the relevant subscription-management mechanism.
Nothing in these Terms limits any consumer rights or refund rights that cannot lawfully be excluded under applicable law.
12. App Store and Third-Party Platforms
Chittoo may be distributed through third-party platforms such as the Apple App Store and Google Play.
Your use of Chittoo through such platforms may also be subject to the applicable platform's terms and policies.
The relevant platform may be responsible for processing payments, managing subscriptions, handling certain refunds, or providing technical support relating to the platform.
Where there is a conflict between these Terms and mandatory terms imposed by the applicable platform, the applicable platform terms will apply to the extent required for that conflict.
13. Third-Party Services and Links
Chittoo may use or link to third-party services, websites, payment providers, technology providers or other external services.
These third-party services may have their own terms and privacy policies.
Chittoo does not control third-party services and is not responsible for their availability, content, security, policies or practices, except to the extent required by applicable law.
Your use of third-party services is subject to the terms applicable to those services.
14. Privacy and Personal Data
Your privacy is important to us.
Our collection, use, storage, disclosure and other processing of personal data is described in our Privacy Policy.
By using Chittoo, you acknowledge that your personal data may be processed as described in the Privacy Policy and in accordance with applicable law.
Depending on the features you use, Chittoo may process information such as account information, learning activity, device information, usage information, text inputs and voice-related information.
Where consent is required by applicable law, Chittoo will seek the appropriate consent and provide applicable mechanisms for exercising privacy rights.

15. Security

However, no internet transmission, software system or electronic storage system can be guaranteed to be completely secure.
You are responsible for taking reasonable steps to protect your account credentials and device.
16. Educational Disclaimer
Chittoo is an educational practice and learning platform.
Our content and AI-generated feedback are intended to support English-language learning and communication practice. They are not a substitute for professional advice, formal educational assessment, employment advice, or any other professional service.
We do not guarantee that using Chittoo will result in a particular examination result, job offer, promotion, level of English proficiency or other outcome.
Individual learning outcomes depend on many factors, including the user's level, practice, consistency and circumstances.
17. Service Availability
We aim to provide a reliable service, but we do not guarantee that Chittoo will always be available, uninterrupted or error-free.
The service may occasionally be unavailable because of:
maintenance;
upgrades;
technical issues;
network or internet failures;
third-party service interruptions;
security incidents;
circumstances beyond our reasonable control; or
other operational reasons.
We may add, modify, suspend or discontinue features of Chittoo from time to time.
Where required by applicable law, we will provide appropriate notice of material changes.
18. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Chittoo is provided on an "as is" and "as available" basis.
We do not guarantee that:
the service will always be available;
the service will be uninterrupted or error-free;
all content will always be accurate or current;
AI-generated responses will always be accurate;
pronunciation or language assessments will always be correct;
the service will meet every user's individual requirements; or
a particular learning or professional outcome will result from using Chittoo.
Nothing in these Terms excludes any warranty, guarantee or consumer right that cannot legally be excluded under applicable law.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Chittoo Technologies India Private Limited and its directors, employees, affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from or relating to your use of the service.
This may include, to the extent permitted by applicable law, loss of profits, business opportunities, goodwill, data or anticipated savings.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
20. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Chittoo Technologies India Private Limited and its directors, officers, employees and affiliates from claims, losses, liabilities, damages, costs and expenses arising from:
your violation of these Terms;
your unlawful use of the service;
your User Content; or
your violation of another person's rights.
This provision will apply only to the extent permitted by applicable law.
21. Suspension and Termination
You may stop using Chittoo at any time.
We may suspend or terminate your access to Chittoo where reasonably necessary if:
you materially breach these Terms;
you engage in unlawful or fraudulent activity;
your use creates a security or operational risk;
you attempt to misuse or circumvent the service;
suspension or termination is required by law; or
the service is discontinued.
Where appropriate and permitted by law, we will provide notice before terminating access for a breach and give you a reasonable opportunity to address the issue.
Termination does not affect rights or obligations that accrued before termination or provisions that are intended to survive termination.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, technology, business practices or applicable law.
When we make material changes, we will provide appropriate notice where required by law.
The updated Terms will become effective from the date specified in the updated Terms.
Your continued use of Chittoo after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

24. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles, subject to any mandatory rights or protections available to you under applicable law.
Subject to applicable law, the courts having appropriate jurisdiction in Bengaluru, Karnataka, India shall have jurisdiction over disputes arising out of or relating to these Terms or your use of Chittoo.
Nothing in this section is intended to restrict any consumer's right to approach a court, consumer forum, authority or other dispute-resolution mechanism where such right cannot legally be excluded.
25. Entire Agreement
These Terms, together with the Chittoo Privacy Policy and any additional terms expressly applicable to particular Chittoo products or services, constitute the agreement between you and Chittoo concerning your use of the service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
26. No Waiver
If Chittoo does not immediately enforce a provision of these Terms, that does not mean that Chittoo has waived its right to enforce that provision later.
27. Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
Chittoo may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets or similar transaction, subject to applicable law.
